These Terms of Service ("Terms") govern your access to and use of the GoVista digital signage management platform ("Service") operated by GOTONOM A.S. ("Company", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account. You must provide accurate and complete information when creating your account and keep it up to date.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not: (a) use the Service to distribute harmful, offensive, or illegal content; (b) attempt to gain unauthorized access to any part of the Service; (c) interfere with or disrupt the Service or its infrastructure; (d) reverse engineer, decompile, or disassemble the Service; (e) use the Service to infringe upon any third-party intellectual property rights.
4. Intellectual Property
The Service, including its original content, features, and functionality, is owned by GOTONOM A.S. and is protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you upload to the Service, but grant us a license to use, store, and display that content as necessary to provide the Service.
5. Limitation of Liability
To the maximum extent permitted by applicable law, GOTONOM A.S. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or business opportunities, resulting from your use of or inability to use the Service.
6. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.
7. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
